In 1985, a complaint against the RCMP of employment discrimination -- on the grounds of drug dependency -- was rejected by the Canadian Human Rights Commission, which ruled that the prohibition on drug dependency was valid under section 14 (a) of the Canadian Human Rights Act. The premise of this paper is that a well-communicated, written policy prohibiting drug use, and proper documentation of the testing procedure, would prevent similar legal challenges in the future. The paper reviews the types of drug tests available, and the reliability and limitations of such tests. It also discusses the legal problems inherent in such testing, and lists recommendations for policy and procedures in police forces.
