"The separation of powers doctrine is a key component in the Constitution. It is a design that was originally intended by the founders to avoid the usurpation of American government by one of the three branches, the executive, legislative, or judicial. "Judicial activism," by its very definition, is a violation of separation of powers. In Roe v. Wade the Supreme Court took action on a legislative decision, overstepping its constitutional bounds. The Court's decision in Roe is and example of judicial activism; as such, it is also a violation of the separation of powers and the U.S. Constitution.
