This report presents findings of the Council with regard to a request from the Nova Scotia Attorney General to inquire whether any or all of three judges (Gordon Hart, Malachi Jones, and Angus Macdonald) should be removed from office, based on the conduct which has been examined by the Royal Commission on the Donald Marshall, Jr., Prosecution. It reviews facts of the Marshall trial, reviews the establishment of the inquiry committee, discusses the test for removal of judges, and sets out the principal issue of the inquiry: whether the court's characterization of Mr. Marshall constituted misconduct justifying removal from office. Finally, the development of this issue in the arguments of the judges & various counsel at the Marshall trial is reviewed and the Judicial Council decision is presented along with detailed reasons for the decision.
