This report presents the evidence & findings of an inquiry into the conduct of Mr. Justice Jean Bienvenue during & after a trial held at the Trois-Rivièeres Superior Court of Quebec in the case of R. v. Tracy Théberge. The inquiry examined whether the judge was guilty of misconduct under the Judges Act for remarks made during the trial and whether he failed in the due execution of the office of judge when he met with jurors in private after the verdict, but before sentencing, to criticize their verdict. The report concludes with the inquiry committee decision regarding violation of the Judges Act and whether the judge should be removed from office. The reasons of a dissenting member of the committee are appended.
