This work is the result of research by the author, architect, and professor Carlos Eduardo Mesquita Pedone, with the advisor and co-author Prof. Dr. Adir Ubaldo Rech as advisor. This research complemented the doctoral dissertation research for publication purposes, incorporating interdisciplinary approaches and knowledge into the more legal aspects. In the course of constructing this scientific and legal work, we initially examine the city's environment and its economic development, examining the lack of environmental protection policies in improvised urbanization, which has some urban planning rules but no environmental concerns. We will then analyze the legal instruments available in our legal system that allow them, even in consolidated environments, to be used to protect riparian areas and water resources. Finally, we will present a specific case from the city of Caxias do Sul, known as Arroio Pinhal. This case includes field research that combines and combines legal instruments to protect water resources.
