The issue presented is whether the United States Supreme Court should grant certiorari to determine whether a state law (here, Maryland's) authorizing the collection of DNA samples from those arrested for (and not necessarily charged with or convicted of) for certain offenses ("DNA arrest laws" or "DNA collection laws") violates the Fourth Amendment protection against unreasonable searches. Among the issues raised are privacy concerns and the likely disproportionate effect of the practice on minorities.
