Irregular and forced migration continues to pose challenges for governments around the world. At the end of 2011 the United Nations High Commissioner for Refugees was providing assistance to around 25.9 million people worldwide, 10.4 million of whom were refugees. The number of people who became refugees in 2011--800 000--was the highest for more than a decade ... this paper examines first some of the more recent international research, and second, relevant Australian case law and the more limited body of Australian research on people smuggling, to determine whether this business model can be identified. It does not seek to evaluate the appropriateness or efficacy of specific anti-people smuggling policies that have been or are currently being pursued by Australian Governments.
